By accessing or using feel.tech (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

The Service is intended for users who are at least 18 years old. By using feel.tech, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the Service.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to terminate accounts at our sole discretion, with or without notice.

feel.tech is an AI-powered emotional wellness tool that helps users identify and understand their emotions. The Service is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We make no guarantees regarding availability, accuracy, or reliability of the Service.

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant feel.tech a non-exclusive, worldwide, royalty-free, perpetual license to use, process, store, and transmit your User Content solely for the purpose of providing and improving the Service.

This license includes the right to use AI services to process your emotional descriptions. We may also use aggregated and anonymized data derived from User Content for any purpose, including research and service improvement.

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Use automated means (bots, scrapers, etc.) to access the Service
• Attempt to circumvent any security measures or access controls
• Use the Service for any commercial purpose without our authorization
• Submit content that is harmful, abusive, threatening, or objectionable
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers

The Service uses artificial intelligence to generate emotional analysis and suggestions. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or inappropriate
• We make no warranty regarding the accuracy of AI outputs
• You are solely responsible for evaluating and acting upon any AI suggestions
• You assume all risk associated with reliance on AI-generated content

The Service and all associated content, features, and functionality (excluding User Content) are owned by feel.tech and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service without our express written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FEEL.TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless feel.tech and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms. We reserve the right to assume exclusive control of the defense of any claim subject to indemnification.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Arbitration: Any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wyoming, and the arbitrator's decision shall be final and binding.

CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court.

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the Service settings. No refunds will be provided upon termination.

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

• Entire Agreement: These Terms constitute the entire agreement between you and feel.tech regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.
• No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
• Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
• Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control.
